Definitions
· The ‘Hire Company’ is Picnic Party Hire
· The ‘Client’ refers to any individual, firm, or corporation hiring equipment or appoints services from the ‘Hire Company’.
· The ‘Equipment’ refers to all crockery, cutlery, glassware, picnic equipment and props supplied to the ‘Client’.
· The ‘Event Date’ is the day of the event supplied by the ‘Client’ to the ‘Hire Company’.
· The ‘Hire Period’ is the total time the ‘Client’ will have in their possession the ‘Equipment’ for hire, as agreed with the ‘Hire Company’.
Conditions of Hire
Hire of equipment for a specified event date will not be confirmed until the deposit fee has been paid to. Until the fee has been received, The Hire Company reserves the right to liaise with other clients for the same event date and equipment. By booking and paying the fee, the client understands and agrees to the Terms & Conditions of hire.
Quotations
In the case where a manual quotation is provided: all quotations expire within 21 calendar days. The Hire Company reserves the right to adjust prices on any piece of equipment once the original quote has expired. A quotation does not “hold” the equipment until the fee has been paid.
Final Payment
Equipment will not be released to the client until full payment has been received. The final balance must be cleared in The Hire Company’s account prior to collection/delivery. By making full payment the client understands and agrees to the terms and conditions of The Hire Company.
Guest numbers may be increased at any time up until 2 days out from the agreed date of hire subject to equipment availability. Numbers may be reduced by 20% only once the deposit fee has been paid, and up until 7 days out from the agreed date of the event date. Reductions greater than 20% after the deposit fee has been paid will result in 50% of the price of the reduced stock being charged as other bookings will have been turned away.
For indoor venues where a hire fee is required, the customer is liable for the hire fee for the time required for the setup and pack down of the event, in addition to the booking time.
Security damage deposit/Bond
A security damage deposit/bond will be required for all picnic hires. The initial booking deposit becomes the bond on the day of the picnic after the final payment has been made. The bond will be released upon return of equipment in its original condition, less any charges incurred for missing, broken, or damaged equipment. Please allow up to 72 hours after the return of equipment to allow The Hire Company to thoroughly check each piece and refund the bond.
Missing, Broken & Damaged Equipment
All of our equipment is used on a regular basis therefore, reasonable signs of wear and tear are to be expected.
Each piece is carefully inspected prior to packing. However, the client will be required to inspect the equipment upon receipt to ensure all requested items have been provided and that each piece is free of damage and makes contact with The Hire Company if there are any issues. Failure to contact The Hire Company will result in the client being liable for any damage. The client is liable for any equipment damaged in transit if being transported by the client.

If an item is broken, the client should take a photo and send it to The Hire Company for records.

Under no circumstances should picnic gears i.e. rugs, cushions, etc be placed on the muddy ground or muddy grass. If rugs are returned with mud on them the full replacement cost will be charged to the client. Shoes must be removed before walking on picnic rugs.

All spills and food drops on the picnic rug need to be cleaned immediately using water.

If picnic rug/s or soft furnishings are returned soiled i.e. shoe marks, food + drink stains, make-up stains, etc, and are deemed as requiring professional cleaning, the cleaning cost will be billed to the client if the amount exceeds the bond paid.
Hire Period

Outdoor Picnics are quoted on a maximum 4-hour hire of the picnic gears and equipment (2.5hrs for party, 1 hour for setting up, and 0.5 hours for pack up), extra time can be arranged at a cost. Overnight hire is available for parties at home if the client prefers and works in with other bookings the hire company has.

Unless agreed in advance, picnics gears and equipment must be ready to return by 5 pm on the day of hire or 7 pm in daylight savings.
Collection/ Delivery

Delivery is within a 20km radius of Wagga Wagga. Set-up must be within 100 m from parking. Please email or call and check with the hire company prior to booking if you need the delivery and set up outside of this radius.

The collection is from the hire company location, equipment must be transported securely to protect from any damage. The time of collection and return will be agreed upon at the time of booking.

Cancellation
Cancellation not relating to rainy weather
Should you wish to cancel for any reason outside 60 days prior to your event, your deposit will be refundable. Deposits will be forfeited if cancellation is within 30 days of your event. Bookings cancelled within 7 days of the event date will be charged 100% of the total fee.
Cancellation relating to rainy weather
We always suggest having a backup plan, be it under cover at the music bowl, at home on a back patio or inside the lounge room or studio space available to hire at “The Wellness Co” 46 Johnston St.

In the event of cancellation due to a rainy weather forecast, clients can postpone up to 5 days of the event date free of charge. After that, up to 48 hours of the event time, 25% of the total fee is deducted and retained by The Hire Company. Cancellation less than 24 hours before the event date will incur a 60% fee. No refund is available if it rains during set-up.
Packaging and cleaning
To avoid loss of bond, the following steps should be followed:

Please scrape off all food scraps off crockery and tip out all liquid from drinkware.

Clean any spill and food drops on the picnic rug immediately.

Shake off all crumbs and dirt from the picnic rug when packing up if hired a DIY package.

Clients to take all their rubbish with them and not leave any rubbish.

TIP: Take a photo of the items before unpacking so that they can be easily re-packed post-event.
Force Majeure
If the Hirer is unable at any time to perform any of its obligations whether wholly or partly by reason of any cause beyond its control (including without limitation acts of God, inclement weather, strikes, lockouts, bushfires, fires, floods, traffic accidents, riots, pandemics, civil commotion or unrest, acts of government, interference by civil or military authorities, terrorist attacks or act of war) the Hirer may give written notice to that effect to the Client, giving full particulars of such force majeure in which case the obligations of the Hirer under these Terms shall, to the extent that they are affected by the force majeure, be suspended during the term of the force majeure. The Hirer shall not be liable for any loss or damage suffered by the Client as a result of any delays caused by such force majeure events nor will the Hirer be liable for loss or damage suffered by the Client in the event of the Client cancelling or postponing due to a force majeure event.
COVID-19
Cancellation due to Covid-19 - In light of the current circumstances surrounding Covid-19 and Government restrictions that can occur without notice, your deposit will be transferred to another date that is suitable. When it is safe to have your event again. If you choose to cancel and not get credit with your deposit, the deposit will be forfeited. We are allowing a credit to remain on your account for one year.

Food safety
Catering options are quoted subject to the availability of the caterer. Where time has lapsed between quote and confirmation, the availability of the caterer is subject to change. Quoted catering menu options may differ on the date of the event due to availability of produce, and availability of the requested caterer. The customer accepts that the best possible option for catering will be provided on the day of the event however may vary due to unforeseen circumstances.
All food is provided for immediate consumption. Do not leave food in room temperature or above for an extended period of time as this can cause food poisoning. The Australian New Zealand food standard code stated that the total time that a ready-to-eat potentially hazardous food can be kept at temperatures between 5°C and 60°C is 4 hours. After this time the food needs to be discarded.
To be on the safe side, food should be consumed within 3.5 hours from our scheduled arrival time.
Liability
The Hire Company shall in no way be held responsible or accountable for any damage, injury, death or loss of income caused to the client, any third parties, or properties due to the hire of equipment or provided services by The Hire Company. All equipment is hired and is the responsibility of the client until returned to The Hire Company.
Indemnity
The client uses and occupies any venue at their own risk. The client hereby indemnifies Picnic party hire and agrees to keep Picnic party hire indemnified against all actions, suits, proceedings, claims and demands, costs, and expenses whatsoever which may be taken or made against Picnic party hire and/or incurred arising out of injury or damage to any person or property from or during the use of any venue.
For indoor venues where a hire fee is required, the customer is liable for the hire fee for the time required for the setup and pack down of the event, in addition to the booking time. The customer is responsible for locating and coordinating the booking of indoor venues. This does not fall under the responsibility of the Company unless agreed.
